SMS Terms & Conditions (A2P Messaging)

These SMS Terms & Conditions (“SMS Terms”) describe how Seaside Legal Solutions, P.C. (“Seaside Legal”) communicates with you via text messages and your rights and responsibilities when you enroll in or receive our SMS/MMS programs (collectively, “Messaging Program”). By opting in, you agree to these SMS Terms in addition to our Website Terms of Use and Privacy Policy.

Compliance Note: Our Messaging Program is operated through verified A2P channels and follows Twilio’s Messaging Policy, including consent, opt-out, sender identification, usage requirements, and filtering-evasion prohibitions, as well as carrier and industry requirements.

Program Description & Sender Identification

We send reminders, updates, and other messages from (978) 607-3086, a telephone number registered for A2P use. Each message identifies Seaside Legal as the sender.

Opt-In (Consent)

Before receiving any SMS from us, you must provide consent tied to the specific message category, such as marketing or non-marketing. Consent cannot be purchased, sold, or shared. We retain timestamped records of your consent flow. For recurring programs, we confirm your enrollment and include opt-out instructions in the first message.

How you may opt in:

  • Submitting a form on our site with an unchecked consent box describing the program(s) and linking to these SMS Terms and our Privacy Policy.
  • Texting a keyword, such as JOIN or START, to (978) 607-3086, where the call-to-action discloses message types, frequency, and STOP/HELP instructions.
  • Selecting SMS updates during intake with clear disclosures.

TCPA Tip: Marketing texts require prior express written consent with clear disclosures. Keep auditable records.

Message Frequency

Message frequency varies. We disclose typical frequency at opt-in, but actual volume may change based on your interactions, such as replies, purchases, support requests, or security events like verification codes.

Costs & Carriers

Message and data rates may apply. Costs depend on your mobile plan. Carriers are not liable for delayed or undelivered messages. Delivery can be affected by carrier filtering or system outages.

Opt-Out (STOP) & Help (HELP)

You can opt out at any time by replying STOP, or using other accepted keywords such as QUITENDCANCEL, or UNSUBSCRIBE. We will send one final confirmation SMS and cease further messages for that program.

Program Rules, Content Standards & Prohibitions

You agree not to use our Messaging Program to send or request content that is illegal, deceptive, harmful, unwanted, or that attempts to evade carrier filtering, such as snowshoeing or obfuscation.

We prohibit content in restricted categories, including high-risk financial schemes, third-party lead generation, illegal substances, unlawful gambling, and SHAFT content, meaning sex, hate, alcohol, firearms, and tobacco, subject to jurisdictional restrictions and age-gating where permitted.

We may suspend or terminate messaging for violations of these rules, Twilio’s Acceptable Use Policy, or carrier requirements.

Links & URL Shortening

For clarity and deliverability, we may use branded link shortening associated with our verified domain. We do not use generic public shorteners in SMS. Branded short links help recipients recognize our brand and align with carrier best practices.

Link clicks may be measured for performance and fraud prevention, consistent with our Privacy Policy.

Data Privacy, Security & Retention

We collect and process your phone number, consent event details, message logs, and engagement data, including link clicks, to operate the Messaging Program, prevent abuse, and improve service, consistent with our Privacy Policy.

We maintain reasonable technical and organizational safeguards and retain records as required by law and industry guidelines to demonstrate consent and manage opt-outs.

A2P 10DLC Registration & Transparency

For U.S. recipients using local 10-digit long codes (10DLC), our brand and campaigns are registered with The Campaign Registry via Twilio to improve trust and deliverability. Registration helps carriers verify who is sending messages and what is being sent. Unregistered traffic is blocked.

Eligibility & Your Responsibilities

You represent that you are the account holder or have the account holder’s permission for the mobile number provided, that you are 18 or older, or the age of majority in your jurisdiction, and that you will notify us if you change or reassign your number so we can stop messaging that line.

Service Management & Filtering

We may modify message flows, such as throttling or keyword responses, to comply with CTIA and carrier policies and to reduce unwanted traffic. Carriers may filter messages they deem non-compliant or unwanted.

We work in good faith with our provider to address issues and may suspend messaging to protect the ecosystem.

Disclaimers & Limitation of Liability

Texts may be delayed or undelivered due to carrier performance, device settings, or network issues. The Messaging Program is provided “as is.” To the fullest extent permitted by law, we disclaim warranties and limit liability arising from or related to the program, except where prohibited.

Your jurisdiction’s consumer laws may grant additional rights.

Changes to These SMS Terms

We may update these SMS Terms to reflect changes in laws, carrier rules, or platform requirements. The “Last updated” date will change when updates are posted. Continued participation after changes constitutes acceptance.
